ARTICLE 5 - DELIVERY

The products are delivered to the address of delivery which you indicated during the process of order. In the event of deliverable articles on different dates taking into account their availability, the delivery period is based on the longest time. INGENOVIE reserves however the possibility of splitting the deliveries. The share in the expenses of handling and shipping will be invoiced only for one sending. INGENOVIE could not be held responsible for the consequences due to a delay of delivery. Any order not dispatched in the 30 days of the order is cancelled except contrary stipulation and announced in the offer of sale. In the event of unusual delay, an email will be addressed to you. The indicated delivery times are non contractual starting from the reception of payment. All risks on the product is transfered to you at the time we hand it over to the delivery company.

ARTICLE 6 - PAYMENT

The payment of your purchases is carried out by bank transfer (our bank accounts numbers are provided to you when you make this choice) or by bank card or credit card via the protected payment system of our online payment partners.  

The products remain the property of  INGENOVIE until the integral payment of the invoiced amount. 

ARTICLE 7: SECURITY

Your online payment are treated directly by our online payment partner.

Ingénovie never sees and does not have access to your financial data such as your numbers of CB or credit card which reside only with the servers of our online payment partner.

ARTICLE 8 - GUARANTEE

8.1 - Description of the guarantees:

We guarantee the products delivered against all the defects which appear under normal conditions of use  in the 12 months following their delivery (exception of the contrary specifications), and which would be due to defects of materials, design, or manufacturing.

8.2 - We can at our choice, repair or replace the products concerned, provided these products or their defective parts are returned over to us, free of port and properly packed, before the expiry of this period 12 months, accompanied by a written complaint specifying the date of purchase and a copy of the invoice.

8.3 - We offer this guarantee to you and you accept it in place of all declarations, conditions or expressed guaranteed or implicit, legal or different, as for the marketable quality the aptitude for a particular use or the performances of the products (or of all materials used in connection with them) or as for the quality of manufacture of these products. It is understood that all these declarations, conditions and guarantees are hereby expressly excluded.

8.4 - Except for any responsibility that we could incur in the event of death or of physical injuries resulting from a negligence, we will not answer in any case to material or physical damages, indirect incidents or consequently which may rise directly or indirectly from the supply from our products, whatever the cause of this damage, and whatever the base of responsibility accused (contractual liability, quasi-criminal responsibility, erroneous interpretation of our declaration or others). 

ARTICLE 12 - RESPONSIBILITY

The offered products are in conformity with the applicable French legislation. The responsibility of INGENOVIE could not be committed in the event of non-observance of the legislation of the country where the products are delivered. It rests on your responsibility to check with the local authorities the possibilities of importation or use of the products or services that your plan to order.

The reproduced photographs and texts and illustrating the products presented are not contractual. Consequently, the responsibility of INGENOVIE could not be committed in the event of error in one of these photographs or one of these texts.

INGENOVIE could not be held responsible for the inexecution of the contract concluded in the event of unavailability or out-of-stock condition of the product, force-majeur, disturbance or all-out or partial strike (in particular mail service and means of transport and/or communications), flood, fire.

INGENOVIE will not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, loss of chance, damage or expenses.

You are responsible for the appropriateness of the products and the applications that you are planning to do. We have taken all the possible precautions to garantie the exactness of the informations given in our catalog.

We decline any responsibility for the lost and prejudices that leads from the errors in the information given. Whatever the circumstances are, we are not assuming any contractual liability, quasi-criminal responsibility, for negligence or failure of any kind that would be attributed to us or would be attributed to our employees, and we decline any responsibility as well, for any profit loss or loss or prejudices indirectly declining from whatever cause. 

ARTICLE 13 - APPLICABLE LAW - LITIGATIONS

This contract is subjected to the French law.

The language of this contract is the French language.

In the event of litigation the French courts will be only qualified.

ARTICLE 14 - DATA PROCESSING AND FREEDOM

The personal information collected (name, addresses, bought e-mail, telephone, objects) by Ingenovie will never be sold neither rented nor divided with a third party. In accordance with the provisions of article 34 of Data-processing and Freedom law of January 6, 1978, you have the right of access and correction to the data which concern you by addressing to:
